Legal Support Services
CCC provides the legal services of Expert Witness, Engineering Analysis,
Forensic Engineering, and Claims Investigation in the area of Product
Liability, Design Faults, Environmental Claims, and Chemical Safety.
CCC's employees include Licensed Professional
Engineers, Ph.D.s, and Certified Hazardous Material Managers. Below are
some representative legal service project profiles.
EXPERT WITNESS
- CHEMICAL PROCESS FAILURE TO PERFORM
Review of our client’s
failed chemical process. Served as testifying expert witness, evaluating
chemical process equipment design, performance and contract requirements on
behalf of owner. Conducted additional process design mathematical modeling,
participated in deposition of opposing Experts as well as CCC Dr. Jeff Perl,
led to a successful, “….very amicable.….” pre-trial settlement for our client.
EXPERT WITNESS - INDUSTRIAL FATALITY
Confidential Client - CCC reviewed all accident specifics. Technical review
provided of accident scenario. Result - Case settled out of court.
FRAUD, WASTE AND ABUSE REVIEW
Confidential Client - CCC served as lead technical advisor and reviewer to
evaluate and quantify large-scale fraud in US Government technical contract
work.
SUPERFUND REMEDIATION COST RECOVERY DAMAGE CLAIM REVIEW
Confidential Client - CCC reviewed/validate $50,000,000 of damage claim
requests
ENVIRONMENTAL DAMAGE CLAIM REVIEW
Reviewed costs and environmental effectiveness of $500,000,000 environmental
damage claim by oil refiner. Identified 76% of claim as excessive or
unnecessary. Made presentation as part of settlement negotiations
between insured and insurer. Client achieved favorable settlement.
FORENSIC ENGINEERING - INDUSTRIAL ACCIDENTS
Investigated major accidents, one involving a chemical burn fatality and a
second resulting in a serious burn injury with disfigurement from a reactor
explosion. Root cause of the accidents were
determined, and corrective actions developed jointly with production
facilities. CCC assisted both facilities in upgrading safety and operating
procedures.
ENTERTAINMENT COMPLEX SITING - SAFETY
HAZOP EVALUATION
Building permits for a
$100 million riverside entertainment complex were denied due to adjacent bulk
chemical storage facility with a history of significant accidents. CCC
examined and quantified risk through air emission modeling, explosion and
immediate danger to life and health (IDLH) exposure modeling. Reviewed and
evaluated chemical storage operations and compliance history. CCC engineers
put a dollar value to the risk and recommended improved chemical storage
safety practices, protective measures for the entertainment complex, and fair
value purchase of land. Presentation to State regulatory commission allowed
timely opening of entertainment complex with mutually successful outcome for
all parties.
FORENSIC ENGINEERING - PREMATURE PRODUCT FAILURE
Determined the cause of premature corrosion failure seen in certain buried
electrical boxes. This work, performed for a national manufacturer of these
products, involved investigation of soil corrosion parameters as well as
electron microscopy of before and after metal box samples. These studies
identified the root cause to be manufacturing defects in the galvanizing
process as well as corrosive soil conditions.
